Haj
The permanent committee of Decree was asked the
following question:
Is it permitted
for a woman to perform Haj in the accompaniment of
trustable and reliable group of women if she could
not go to Haj with one of her family (Mihram
member). Is
he permitted to accompany her mother, aunt so that
to be her Mihram?
Answer:
The right opinion is that a
woman is not permitted to travel to Haj excepted
with her husband or a Mihram male (brother,
uncle). She
is not permitted to travel to Haj with trustable
group of women or men (who are not Mihram).
Even she is permitted to travel with her
mother aunt etc… She should travel either with
her husband or with a Mihram man (father, brother
and uncle). If
she does not find Mihram man, she is not required
to perform Haj.
Because she lost the condition of legal
ability. Allah
says, “Pilgrimage thereto is a duty men owe to
Allah those who can afford the journey” [3:97]
The permanent committee of Decree was asked the
following question:
I am a fifty years
old woman. I
want to perform Haj but I am not having a Mihram
to accompany him with me.
My husband’s main concern is money and
the affairs of this world and has no intention to
perform Haj unless he gets the chance of
performing Haj in the expenditure of the company
in which he is worthiness.
However, to achieve this he has to wait for
his turn but I cannot wait until then because I am
afraid that I may die before performing Haj.
I am having the money and the travelling
means. My
sons are busy preparing for their marriage.
Therefore all my Mihrams cannot accompany
me. Is
there is any jurisprudentially outlet which makes
me capable of accompanying my dead brother’s
wife and a group of woman for performing Haj?
It is worth mentioning that I am dressing
Islamic uniform and religious?
Answer:
If you are facing the lack of
a Mihram to accompany you for the purpose of
performing Haj then, you are not required to
perform Haj. In this case it does not become
obligatory on you to perform Haj because you are
not getting an important condition which makes the
performance off Haj possible for a woman, that is
Mihram, (father, brother, uncle or husband) [Refer
to Muslim and Bukari]. Therefore, you can perform good deeds, which doesn’t
require travelling till Allah facilitate Haj for
you by devoting one of your Mihrams to accompany
you.
Shaikh Mohammed Ibn Ibraheem was asked the
following question:
American Muslim
women want to perform Haj how can they perform it?
Answer:
Just claiming to be a Muslim is not enough.
It must be legally proofed in front of
legal rules or a legal judge.
Regarding performance of Haj Quran says,
“Pilgrimage thereto is a duty Men owe to Allah
those who can afford the journey” [3:97].
It is a duty only on the woman who has
means and Mihram who will accompany her to and
from the Holy Land. If
she does not find a Mihram then it is not a duty
on her to perform Haj.
Shaikh Mohammed Ibn Ibraheem was asked the
following question:
Is the husband of a
woman be considered a Mihram for her aunt.
Is this aunt permitted to stay with her at
home? This
aunt is seventy years old and married to a man who
is foreign to her.
Answer:
The mentioned husband is not
a Mihram to your aunt.
Regarding your aunt staying with you at
home, it is not prohibited but they should not be
alone while you are absent.
Shaikh Mohammed Ibn Ibraheem was asked the
following question:
A woman wants to
perform Haj and she is having a son whose age 13
years in addition to a man with his wife.
Answer:
You can perform Haj since you
have a 13 years old son although he is not
fulfilling the condition of being a Mihram due to
his young age but since there is also a group of
trustful women, it is possible and permissible for
you to perform Haj.
The permanent committee of Decree was asked the
following question:
I am a married
woman and wants to perform Haj, my husband
performed Haj more than five times I requested him
to allow me to perform Haj, he agreed but when it
was the time of Haj he prohibited me from going to
Haj and wanted me to go with one of my daughters
husbands? Once
I asked my husband to allow me to accompany one of
my daughters with her husband but he refused.
Answer:
You can go with one of who
you mentioned even if your husband refuses to give
you permission.
Because you must perform the duty of Haj
since you have all the conditions required to
fulfil this duty money means and Mihram and you
are not required to obey any creature at the cost
of obeying Allah.
The permanent committee of Decree was asked the
following question:
The opinion of
religion regarding a woman who goes to Haj without
getting the permission of her husband?
Answer:
The performance of Haj as an
obligation is a duty if the conditions required
for its performance are fulfilled.
They are the conditions of capability.
Getting the husband permission is not one
of these conditions and he is not permitted to
prohibit her rather he should cooperate with her
to enable her to perform the duty of Haj.
Shaikh Abdel Rahman Elsedi was asked the
following question:
Scholars said that
the expenditure on women’s Mihram (her legal
companion t Haj) in the journey to and from Haj is
the responsibility of the woman.
What do they mean by this opinion?
Answer:
Scholars mean that the
woman’s duty is to prepare provision whereas of
transport is the responsibilities of the Mihram.
Shaikh Elsadi was asked the following question:
An old blind
woman wants to perform Haj.
Is it permitted to perform Haj in her
favour?
Answer:
If she can travel it would be better for
her to perform Haj herself.
Today it is easy for every one to travel
and since she has sons, they can be her Mihram and
accompany her.
Shaikh Abdel Aziz Bin Baz was asked the
following question:
A poor woman
performed Haj in the accompaniment foreign people.
At first she asked one of her relatives to
accompany her.
They refused.
Therefore, she went with two woman and a
man. Is
her Haj correct?
Answer:
Yes, her Haj is correct, but
the only incorrect, but the only incorrect thing
is that she has gone without a Mihram.
Therefore, she must repent to Allah and
seek his forgiveness.
Shaikh Mohammed Bin Salih El-Otheimeen was asked
the following question:
A pious woman in
the middle age & rather more near to the old
age. She
wants to perform the duty of Haj but she doesn’t
have a Mihram.
A good and pious man from the same area
wants to perform Haj and some of his Mihram women
are going with him.
Can she accompany them?
It is worth mentioning that she is
financially able woman?
Answer:
She is not permitted to
perform Haj even in the accompaniment of a group
of trustful women and a pious, because she is not
having her own Mihram.
The prophet Mohammed (PBUH) said, “A
woman must not travel without a Mihram”
A man said to the prophet, “My wife went
for Haj and I am registered to go for holy war”
the prophet said to him, “Hurry up and
perform Haj with your wife” this means that the
prophet (PBUH) did not ask him whether his wife
was with trustful women or not, with a pious man
or not. Although his name was registered with those who are going for
holy war the prophet (PBUH) ordered him to leave
the holy war and reach his wife.
People of knowledge say that if women were
not having a Mihram she is not required to perform
Haj even if she does not perform it until she
dies.
The permanent committee of Decree was asked the
following question:
Is it permitted for
my wife to perform Haj by my money (on my
expenditure) and is her Haj correct?
Answer:
Yes, it is permitted and her
Haj is correct and Allah bestows his boon on you
because you helped your wife to do so.
Shaikh Mohammed Ibn Ibraheem was asked the
following question:
I fasted
Ramadan in Jaddah and wore Ihram on the 8th
of Thilhijja in Jaddah and completed the rites of
Haj. Should
I offer sacrifice?
Answer:
No, you are not required to
offer any sacrifice.
Shaikh Mohammed Ibn Ibraheem was asked the
following question:
What is the opinion
of religion regarding a person who kisses the
black stone as soon as he starts circling?
Answer:
According to Sunna it is
better not to emulate on it and it is not
permitted for women and also Raml (mild running)
is not permitted for women and it is preferable
that they become as far from the holy house as
possible because they are Awra (all their body is
an object of attraction) if there is emulation
around the Black Stone it is better for her to be
away and protect her body an in such emulation it
is not required by her to kiss the black stone.
Shaikh Mohammed Ibn Ibraheem was asked the
following question:
What is the
opinion of religious about the prayer of a woman
behind the stand of Ibraheem (PBUH)?
Answer:
If it was a crowded area then she is
permitted to leave it since the body if a woman is
Awra (her body is an object of attraction) it is
permitted an preferable not to enter into crowded
areas where men are gathering.
A woman can pray behind the stand of
Ibraheem PBUH and can kiss the black stone it the
groups of people at these places were
predominantly women.
